1. Service Agreement: Client is entitled to a one-time family photography service as per the agreed package.
2. Pricing: Prices are quoted based on the specific requests and requirements of each Client.
Booking Confirmation: A non-refundable deposit of RM100 is required to secure your session date and time. This deposit will be deducted from the total package price.
3. Rescheduling Policy: Rescheduling is allowed if requested at least 7 days before the session.
- Rescheduling requests within 7 days of the session will incur a fee of RM50.
- Rescheduling is subject to availability.
4. Payment Terms: The remaining balance is due on the day of the session and can be paid via cash, bank transfer, or e-wallet.
5. Shooting Location Fees: Shooting location entrance fees, if applicable, are not included in the package and must be borne by the client.
6. Session Details: Sessions are strictly limited to the agreed-upon duration. Additional time may be charged.
7. Late Arrivals: Late arrivals will result in reduced session time, and the session will still end at the scheduled time. Arrivals over 30 minutes late may lead to session cancellation and deposit forfeiture.
8. Weather Policy: Outdoor sessions may be rescheduled due to bad weather at no extra charge, subject to availability. Alternatively, the session can be moved to the studio or another indoor location.
9. Props and Outfits: Clients are responsible for providing their own props and outfits.
10. Photo Delivery: Edited photos will be delivered online within 4 weeks of the session. Delivery timelines may vary during peak seasons.
11. Photo Editing: All photographs will undergo editing solely in our distinctive style. Provision of RAW or unedited footage is not included. Additional editing requests may be subject to extra charges.
12. Travel Fees: A travel fee applies for locations outside Penang Island. Travel arrangements for outdoor sessions must be confirmed in advance.
13. Copyright and Usage Rights: The Client acknowledges that we hold the copyright for all photos taken during the session.
We reserve the right to use any images for marketing, promotional activities, and competitions unless the Client opts out in writing before the session.
14. Digital File Storage: Edited photos will be stored for up to 1 year from the delivery date. Clients are advised to download and back up their files promptly.
15. Client Responsibilities: Clients are responsible for ensuring children and family members cooperate during the session. Please arrive on time to avoid any reduction in your photography session duration.
16. Liability: We are not responsible for the Client’s safety, damages, or unforeseen circumstances during our services. Costs for repairing or replacing damaged or lost property due to Client actions shall be borne by the Client.
17. Force Majeure: If we cannot perform this Agreement in whole or in part due to a fire, natural disaster, act of war or terrorism, epidemic or pandemic (including COVID-19), action of any governmental authority, national or regional emergency, other casualty, act of God, or other cause beyond our control, we shall have no obligation to perform under this Agreement and no liability for delays or failures to perform. We may, in our discretion, work with the Client to find an alternative date for the session that is suitable to both parties.
18. Amendment Rights: We reserve the right to amend these terms and conditions at any time, with subsequent notification to the Client.
19. Agreement to Terms: By booking a session with Those Days, clients acknowledge and agree to abide by these terms and conditions.
